Terms of Service
Last updated: 24 March 2026
We believe good marketing takes time, consistency, and alignment.
That’s why we work with clear terms, a minimum commitment, and full transparency on what we do and don’t guarantee.
No shortcuts, no inflated promises, just focused work that builds real growth.
1. Introduction
These Terms of Service apply to the use of this website and all services provided by Lum Collective.
By accessing this website or engaging with our services, you agree to these terms. These terms are designed to create clarity on how we work, what you can expect from us, and what we expect in return.
If you do not agree with these terms, please refrain from using the website or our services.
- About Lum Collective
Lum Collective is a marketing agency based in Spain. We support companies with strategy, content creation, SEO, advertising, and digital growth.
Website: https://lum-collective.com
Contact: info@lum-collective.com
We operate as a strategic partner, not just an executional provider. This means our work is focused on building long-term growth systems rather than delivering isolated one-off outputs.
3. Scope of services
Our services are tailored to each client and are defined in proposals, agreements, or written confirmations. These documents outline the scope, deliverables, timelines, and pricing.
The scope of work may include strategy, digital setup, content creation, performance marketing, or ongoing optimization. Any additional requests outside the agreed scope will be reviewed and may result in additional costs.
In practice, this means:
- Deliverables are defined upfront and aligned with your business goals
- Changes or additions during the project are handled transparently
- We focus on execution within a clear strategic framework
4. Duration of collaboration
To achieve meaningful and sustainable results, Lum Collective typically works with a minimum collaboration period of 6 months, unless agreed otherwise in writing.
Marketing performance is built over time through testing, iteration, and consistent execution. Short-term projects often do not allow enough time to validate strategy or generate reliable results.
During this period, we focus on:
- Building a strong digital foundation
- Testing channels, messaging, and audiences
- Optimizing performance based on data
- Creating consistency in visibility and conversion
5. Pricing and payment terms
All prices are stated in Euros (€) unless explicitly agreed otherwise in writing.
Invoices are issued according to the agreed structure (project-based, monthly, or milestone-based) and are payable within 30 days of the invoice date.
To ensure continuity and commitment on both sides:
- Work may be paused in case of overdue payments
- Timelines may be adjusted accordingly
- Ongoing services may be suspended until payment is received
In case of structural delays in payment, Lum Collective reserves the right to terminate the collaboration.
- Third-party tools, platforms, and collaborators
To deliver our services effectively, we may use third-party tools, platforms, or external collaborators. These may include software providers, hosting services, analytics tools, advertising platforms, or creative specialists.
Unless explicitly stated, third-party costs are not included in our pricing.
This includes, but is not limited to:
- Advertising budgets (e.g. Google Ads, Meta Ads)
- Software subscriptions or licenses
- Booking or CRM systems
- External production (photography, video, design)
When working with external collaborators such as freelancers or specialists:
- Their involvement will be aligned with the project scope
- Costs will be communicated in advance
- They are paid once the client payment has been received
7. Client responsibilities
A successful collaboration depends on active involvement from both sides. The client plays a key role in enabling progress and results.
The client agrees to:
- Provide accurate and complete information
- Share necessary assets, materials, and credentials
- Provide feedback and approvals within a reasonable timeframe
- Ensure internal alignment when decisions are required
Delays in communication, approvals, or delivery of materials may impact timelines and performance. Lum Collective is not responsible for delays caused by missing input or late responses.
8. Revisions, feedback, and approvals
Where applicable, a defined number of revisions is included in the agreed scope (for example in design or website development).
Additional work may be required when:
- The number of revisions exceeds the agreed limit
- Direction changes significantly after approval
- New requirements are introduced during execution
Once deliverables are approved, further changes may be treated as new work and billed accordingly.
9. Performance and results
Lum Collective provides strategic guidance, execution, and continuous optimization based on experience, data, and best practices.
However, we do not guarantee specific results.
This includes, but is not limited to:
- Revenue or business outcomes
- Number of leads, bookings, or conversions
- Social media growth or engagement
- Search engine rankings or visibility
Marketing performance is influenced by factors outside our control, such as market conditions, competition, pricing, product-market fit, and platform algorithms.
Our focus is on building systems that improve performance over time, not on short-term guarantees.
10. Intellectual property
All materials, strategies, and deliverables created by Lum Collective remain our property until full payment has been received.
After full payment:
- The client receives the right to use the agreed deliverables
- Lum Collective retains the right to showcase the work for portfolio and marketing purposes
Any pre-existing materials, tools, or frameworks developed by Lum Collective remain our intellectual property at all times.
11. Confidentiality
Both parties agree to treat all shared information as confidential. This includes business data, strategies, financial information, and any non-public materials.
Information may only be shared with third parties when necessary for the execution of the project or when required by law.
12. Limitation of liability
While we aim to deliver high-quality work, Lum Collective is not liable for indirect or consequential damages.
This includes:
- Loss of revenue or profit
- Loss of data
- Business interruption
- Decisions made based on our recommendations
Our total liability is limited to the amount paid for the services provided.
13. Website use
You agree to use this website only for lawful purposes. You must not attempt to gain unauthorized access, disrupt the website, or misuse any part of it.
We reserve the right to modify or remove website content at any time without notice.
14. Termination
The collaboration is based on a minimum commitment of 6 months unless agreed otherwise.
After this period, either party may terminate the collaboration with written notice.
In all cases:
- Work completed up to that point will be invoiced
- Outstanding payments remain due
- Ongoing work may be paused or concluded
- Changes to these terms
We may update these Terms of Service from time to time to reflect changes in our services or legal requirements. The most recent version will always be available on this page.
16. Governing law
These Terms of Service are governed by the laws of Spain.
Any disputes will be subject to the jurisdiction of the courts of Spain.
